A tutela dos direitos da personalidade post mortem: uma análise a partir dos chatbots de pessoas falecidas

    The objective of this article is to present some ethical-philosophical questions about social networks and the use of data inserted in social networks as a means of recreating the per-sonality of the subject through "chatbots" and their impacts on society. The relevance of this research ispresented in the reflection on the directions that transhumanism has been guiding society, which generates ethical questions about the applicability of classic concepts of human rights in social networks and new technologies and their post mortem protection. The theoretical contribution of this article can be found in the analysis of the cases of chatbots of deceased peo-ple, who reproduce their digital memory, and how such technology can affect the rights of the deceased's personality in the absence of authorization to do so, or even the lack of supervision and control by the programming platforms. In the results, it can be seen that there is a quest to immortalize life at all costs, even if it is through digital technologies. This fact leads to the need toobtain means of inspection and control of the use of people's digital memory, so that there is no virtual reproduction of a person on the networks. The hypothetical-deductive method is used in this research, based on the elaboration of some philosophical questions, as well as the tech-nique of reading books and scientific articles that deal with the proposed theme. Finally, docu-mentary research is applied through the analysis of related news.

    O objetivo deste artigo é o de apresentar alguns questionamentos ético-filosóficos acerca das redes sociais e o uso dos dados inseridos nas redes sociais como meio de se recriar a personalidade do sujeito por meio dos “chatbots” e seus impactos na sociedade. A relevância desta pesquisa se apresenta na reflexão quanto aos rumos que o transumanismo vem orientando a sociedade, o que gera os questionamentos éticos quanto à aplicabilidade dos conceitos clássicos dos direitoshumanos nas redes sociais e novas tecnologias e a sua tutela post mortem.A contri-buição teórica desde artigo pode ser encontrada na análise dos casos dos chatbotsde pessoas falecidas, que reproduzem a sua memória digital, e como tal tecnologia pode afetar os direitos da personalidade de cujusante a ausência de autorização para tal ou, ainda, a falta de fiscalização e controle por parte das plataformas de programação. Nos resultados, pode-se perceber que há uma busca em eternizar a vida a todo custo, mesmo que seja por meio das tecnologias digitais. Tal fato leva à necessidade de se obter meios de fiscalização e controle do uso da memória digital das pessoas, para que não haja a reprodução virtual de uma pessoa nas redes. Utiliza-se nesta pesquisa o método hipotético-dedutivo, a partir da elaboração de alguns questionamentos de cu-nho filosófico, bem como a técnica da leitura de livros e artigos científicos que tratam do tema proposto. Por fim, aplica-se a pesquisa documental através da análise de notícias relacionadas.
