    El presente documento expondrá los antecedentes que dieron origen a la creación del Sistema de Garantías y Protección a los Derechos de la Niñez, promulgado en la ley 21.302. Se revisarán sus principales aciertos, e iluminando desde el paradigma de la Justicia Terapéutica, aquellos elementos que se mantienen sin recibir modificaciones tras la creación del nuevo Servicio. De este modo, la Justicia Terapéutica servirá como hoja de ruta para identificar el potencial dañino de aspectos que persisten en el sistema, y que, de no ser modificados, continuarán perpetuando las múltiples prácticas de vulneraciones de derecho que, tras décadas de puesta en marcha, aún no logran ser erradicadas.

    This document will present the antecedents that gave rise to thecreation of the System of Guarantees and Protection of the Rights of the Child, promulgated in Law 21,302.Based on this, its main successes will be reviewed, and illuminating from the Therapeutic JurisprudenceParadigm, those elements that remain unchanged after the creation of thenew Service.In this way, Therapeutic Jurisprudencewill serve as a roadmap to identify the harmful potential of aspects that persist in the system, and that, if not modified,will continue to perpetuate the multiple practices of violations of law that, after decades of implementation, have not yet been eradicated.
