The article proposes a reflection on the victim's participation in the criminalprocess from the Economic Analysis of Law, notably the Economic Theory ofCrime (ETC).The problem consists of identifying what underpins the victim's participation in the criminal processand the potential said participation has ininfluencing the decision making process from the perspective of the ETC. It is possible to verify by using the deductive approach,bibliographical and documentary research reveal that the redefinition of the victim in the process is seen as enforcement to deter the commission of crimes by acting as amotivating factor to diminish criminal potential. At the end, a new mathematical formula representing criminal decision-making is proposed
O presente artigo propõe reflexão acerca da participação da vítima no processopenalapartirdaAnáliseEconômicadoDireito,notadamentedaTeoriaEconômica do Crime (TEC). O problema enfrentado consiste em identificar oque fundamenta a participação da vítima no processo penal e o potencial queessa participação tem de influenciar a tomada de decisão, na perspectiva daTEC.Verifica-se que a ressignificação da vítima no processo é vistacomo enforcement à abstenção de praticar crimes por atuar comovariáveldemoventeaopotencialcriminoso.Considera-se, ao final que a novafórmulamatemática que representa a decisão criminosa.
