The doctoral thesis analyzes the labor and social protection problems associated with older workers from 45 years old. It examines the employment statute of older workers, specifically: the existing active and passive employment policies in Spain and Catalonia that target older workers, the retirement regulation in Spain and the scope of legal protection against age discrimination in International, European and Spanish legislation, comparing it with the anti-discrimination law of the United States as it was the pioneer country in enacting an act prohibiting age discrimination in employment
