This thesis conducts a legal analysis of the effectiveness of the protection of foreign workers’ right to safety and health at work. Even though this is a right attached to the legal status of any worker, regardless of their nationality and their administrative status, the effective implementation of such right differs depending on the workers’ collective. The thesis analyzes current immigration laws with particular regard to access to the labor market for non-EU workers and occupational safety laws focusing on those aspects of the law which can impact on the effective implementation of a worker’s right to safety at work. The final section of this thesis discusses, from a professional standpoint, social protection for migrant workers in a non-regulated situation
