    La presente tesis tiene por objeto el estudio del deber de mitigar el daño evitable por parte de la víctima en general, y su impacto orgánico en el sistema de responsabilidad civil en particular, desde un enfoque sociológico, económico, filosófico y jurídico. Finalmente, proponemos una integración del régimen jurídico aplicable a la figura en aquellos aspectos que no se hallen específicamente regulados en la norma legal. A tal fin, nos hemos centrado en el ámbito de aplicación del instituto, sus requisitos, presupuestos, modalidades expresivas, límites, efectos, carga de la prueba, costas, fórmulas de aplicación judicial, etc.

    The purpose of this thesis is to study the duty to mitigate avoidable harm on the part of the victim in general and its organic impact on the civil liability system in particular, from a sociological, economic, philosophical and legal perspective. Finally, we propose an integration of the legal regime applicable to the figure in those aspects that are not specifically regulated in the legal norm. To this end, we have focused on the scope of application of the institute, its requirements, budgets, expressive modalities, limits, effects, burden of proof, costs, formulas of judicial application, etc.
