    • Nunca una ley con tan pocos artículos, ha originado tantas discusiones doctrinales ni resoluciones tan dispares de los tribunales de Justicia. Nunca una ley tan antigua ha estado, desgraciadamente, tan vigente, casi cincuenta años después de su nacimiento. El sistema garante ideado por el legislador de la Ley 57/1968, en protección de los adquirentes de viviendas que anticipaban cantidades al promotor para su construcción, no solo era avanzado para su época, sino que aún hoy, se revela suficiente y a la altura para la consecución de sus muy loables objetivos. Ello no es óbice, sin embargo, para afirmar que adolece de carencias, en parte subsanadas por la reciente reforma legislativa, motivada por la evolución jurisprudencial en la materia que ha concluido, tras una labor de integración del ordenamiento jurídico, digna de alabanza, en el dictamen de una doctrina jurisprudencial sobre la materia.

      Objetivos El objetivo de esta tesis es plantear una interpretación certera e indiscutible sobre el alcance, límites cuantitativos y temporales y ejecución, de las garantías prestadas mediante seguro de caución o aval solidario, en íntima relación con la otra medida asegurativa establecida por el legislador en la Ley, la cuenta especial, y concretamente, con la importancia del ingreso de las cantidades en la cuenta especial para comprender y establecer su repercusión sobre el alcance de las referidas garantías, y por ende, determinar la responsabilidad de las entidades garantes en la devolución de las cantidades entregadas a cuenta. Como objetivo secundario se platea conciliar los intereses de los consumidores con la de los garantes delimitando los derechos y obligaciones de cada uno de ellos, esencial para comprender el sistema protector recogido en la normativa objeto de análisis.

      Metodología La metodología que se ha seguido es el método histórico crítico y la jurisprudencia de intereses. Se ha analizado tanto el articulado de la Ley 57/1968 como la reciente modificación legislativa en la materia y se han descrito las actuales interpretaciones de la doctrina. Se ha insistido en definir y formular interrogantes que en su respuesta, cuestionen lo anterior y permitan elaborar una interpretación idónea aunando los intereses de los obligados por la Ley, que permita actuar con seguridad jurídica y con conocimiento del alcance de sus responsabilidades al respecto. Con un análisis exhaustivo de la doctrina jurisprudencial, se ha concluido y delimitado los problemas existentes en términos claros y precisos.

      Además, se ha contado con la orientación de los diferentes entes involucrados que han facilitado información sobre la problemática que se les plantea en su quehacer diario y los mecanismos que utilizan para abordarla.

      Resultados El principal resultado obtenido con la investigación, ha sido la delimitación del campo de actuación de las medidas aseguradoras establecidas en la norma y la constatación de su necesaria interrelación en el mecanismo ideado por el legislador para la protección del adquirente que anticipa cantidades para la construcción de la vivienda. Se ha rescatado la importancia del ingreso en la cuenta especial de las cantidades anticipadas, en relación con el alcance de la garantía prestada por la entidad aseguradora o financiera. Se ha puesto al descubierto la necesidad de una nueva reforma en la normativa reguladora y la importancia de la introducción de ciertas prácticas en las entidades garantes que mejoren su actuación y el correcto funcionamiento del sistema.

      Conclusiones En el sistema de garantías regulado por la, a punto de extinguirse, Ley 57/1968, cuyo testigo recoge la Ley de Ordenación de la Edificación, la responsabilidad de las entidades garantes, se extiende más allá de la comprometida al emitir el documento de aval solidario o el certificado individualizado del seguro de caución. Con determinados condicionantes, el alcance de la responsabilidad de dichas entidades se extenderá, por imperativo legal, al importe de las cantidades que hayan sido ingresadas en la cuenta especial. La cuenta especial, revela así, su verdadera importancia, al margen de las relacionadas con la entidad de crédito en el momento de su apertura y en el control del destino de los fondos en ella depositados.

      De idéntica forma, se puede concluir que es determinante, de cara a la ejecución de las garantías, la previa resolución por el adquirente, del contrato de compraventa firmado con el promotor.

Never a law such old has been, unfortunately, so much in force nearly fifty years after its enactment. The guarantee system devised by the legislator in Law 57/1968 –for protecting home purchasers advancing amounts in early payment to the developer for building, not only was then ahead of its time, but still nowadays demonstrates its sufficiency being up to the task of achieving its highly laudable goals. This does not preclude however from stating that it suffers from some shortages, partly remedied by its recent legislative reform –prompted by the case-law developments in this matter, which concluded, after a praiseworthy labor of incorporation in the legal system, with the issuing of a case-law doctrine on the matter.

      Objectives The objective of this thesis is to present an accurate and indisputable interpretation of the characteristics (scope, quantitative and temporal limits, and enforcement) of guarantees issued by surety insurance or (joint-and-several) co-signers guarantee, in close connection with the other insurance measure established in the Law by the legislator –the special account. Particularly, in close connection with the relevance of deposit of amounts in the special account in order to understand and establish its impact on the scope of the aforementioned guarantees, and thus determine the responsibility of the guaranteeing entities (sureties) in the return of the deposited amounts. A secondary objective considered is the reconcilement of the interests of consumers with those of the guarantors, delimiting the rights and obligations of each, which is essential to understand the protective system described in the regulations under review.

      Methodology The methodology followed is the critical historical method and the jurisprudence of interests. We have analyzed both the articles of Law 57/1968 as well as the recent legislative amendment in the matter, and have described the current interpretations of the doctrine. We have striven to define and formulate questions, the answers of which may challenge the aforementioned articles and interpretations, and thus allow the development of a suitable interpretation, combining the interests of those compelled by law, and enabling to act with legal certainty and with knowledge of the extent of their liabilities in this regard. By means of a thorough analysis of the case law, we have concluded with a relation of the existing problems and delimited them in clear and precise terms.

      In addition, we have had access to orientation from the various involved subjects of law which provided information about the problems they face in their daily work and the mechanisms they use to address it.

      Results The main result obtained with this research has been the delimitation of the range of action of the insurance measures laid down in the Law, and the realization of their necessary interaction within the mechanism devised by the legislator to protect the purchaser advancing amounts for home building. It has recovered the relevance of deposit of amounts into the special account in early payment, in relation to the scope of the guarantee provided by the insurance or financial institution. It has exposed the need for further reform in the regulations and the importance of the introduction of certain practices in sureties to improve their performance and the proper functioning of the system.

      Conclusions In the guarantee system ruled by Law 57/1968 –close to extinction and continued by the Law on Construction Planning, the liability of sureties extends beyond that committed when issuing the (joint-and-several) co-signers guarantee document or the individual surety insurance certificate. With certain conditions, the scope of liability for these entities will be extended, under legal compulsion, to the amount of the sums that have been deposited in the special account. The special account thus reveals its true relevance, apart from that related to credit institution liability upon opening of the account and controlling of the use of funds deposited therein.

      In precisely the same manner, we can conclude that it is crucial, when faced to enforcing the security rights (guarantees), the previous termination by the purchaser of the sale contract signed with the promoter.
