SYSTEMATIC STUDY OF THE AGREEMENT BETWEEN THE REPUBLIC OF EQUATORIAL GUINEA AND THE HOLY SEE ON RELATIONS BETWEEN THE CATHOLIC CHURCH AND THE STATE Church-State Agreements are currently the best formula to ensure that; on the one hand, the Church is guaranteed the autonomy and freedom necessary to exercise her pastoral, educational and charitable mission and, on the other hand, that the State undertakes to guarantee citizens the necessary means to facilitate the exercise of their right to religious freedom, especially in those places where fundamental rights are not fully respected. This study intends to investigate whether this Agreement between the Equatorial Guinean State and the Holy See meets these expectations, analyzing the context in which it was signed, the laws to which it refers and all the matters agreed upon. The legal nature of the Agreement should lead to a real modification of the previous situation. However, its effectiveness is diminished by the submission of many matters to the internal laws of the country and their evolution, due to their characteristics. Nevertheless, the referral to future minor agreements of many of these matters opens a hopeful horizon that requires legal rigor, detailing the issues without leaving room for interpretation, promoting the implementation mechanisms of all that has been agreed. The effectiveness of the main Agreement depends on these minor agreements, although so far, ten years later, none has been signed. Keywords: Concordance, religious freedom, Equatorial Guinea
