La garantía institucional es una categoría jurídica que tiene como finalidad la protección de una institución reconocida por la Constitución, pero no regulada por ella, protección que consiste en que el legislador ordinario tiene vedada la eliminación de la institución, pero también vaciarla de contenido, mediante el respeto de su imagen maestra. El notariado colombiano cumple las condiciones para tener la calidad de una institución protegida por la garantía estudiada, lo que le protege de ser eliminado por el legislador ordinario, como de ser vaciado de contenido, respetándose así su imagen maestra.
