    Resumen: Este trabajo es una recopilación de los delitos cometidos contra el patrimonio histórico y artístico español en época reciente (desde la segunda mitad del siglo XX hasta nuestros días). De estos delitos, tan solo conocemos la punta del iceberg. El enfoque de esta monografía es desde una perspectiva múltiple, se estudian los principales delitos, cómo se han producido, las causas que los han provocado y las formas de prevención.

    Esta obra se ha dividido en tres bloques. El primero trata sobre las principales operaciones policiales contra los expolios del patrimonio terrestre y del subacuático. Otro apartado trata sobre los robos más importantes dividiéndolos en: robos a particulares, robos a la iglesia, y los cometidos contra el patrimonio documental o bibliográfico. Analizamos como éstos se comercializan ilícitamente en el mercado negro.

    En segundo capítulo, sobre falsificaciones y fraudes en el arte se definen conceptos como original, falso, plagio, réplica, y se estudian los diferentes tipos de falsificaciones en pintura, dibujo, obra gráfica, escultura, documentación de la obra, la firma, etc, y las técnicas para la detección del engaño. Los agentes que intervienen en dichos fraudes pueden ser coleccionistas, artistas, expertos e historiadores del arte, restauradores, marchantes, galeristas, casas de subastas, museos, etc. También estudiamos los falsificadores de arte mas importantes y los artistas más falsificados.

    Finalmente tratamos la legislación y las principales instituciones nacionales e internacionales involucradas en evitar y prevenir estos delitos: La Dirección General de BBBA, la Junta de Calificación del PHE, (Ministerio de Educación), el Ministerio de Hacienda, el de Asuntos Exteriores y de Cooperación (con la Agencia Tributaria y el Departamento de Aduanas e Impuestos Especiales), y el Ministerio de Justicia, con la Fiscalía Coordinadora de Medio Ambiente y Urbanismo. Deteniéndonos en el Mº del Interior, del que dependen la Brigada de Patrimonio Histórico de la Policía Nacional y el Grupo de Patrimonio Histórico de la Guardia Civil.

    Finalmente se verán los organismos internacionales, que luchan contra el tráfico ilícito de bienes culturales como son la Interpol, Europol, el ICOM, la COMJIB, Eurojust (Justicia Europea) o la Unesco, y las legislaciones en las que se basan.

    This work is a collection of crimes committed against the Spanish artistic and historical heritage of recent times, from the second half of the 20th Century until our present day. Of these crimes we have only uncovered the tip of the iceberg. The focus of study of this work has arisen from multiple perspectives. On the one hand, we study the main crimes, and on the other hand, the various phenomenas that have occured, the causes that have led them and ways to prevent them. There are several points to this work: guide and raise awareness among the general public about these phenomenas, as well as start a new line of research in a field that, until now has not been studied much, which serves as a point of departure for further work on these subjects. The work has been divided into three sections. The first relates to plundering, theft and smuggling; the second, on counterfeiting and fraud, and the third is on the national and international institutions for the protection of Spanish Historical Heritage. The first section contains a compilation of the most important police operations in recent times on these matters. The theft of art in general, studying in particular the plundering of archaeological heritage (both on the land and in the underwater). After a brief review of the recent techniques used by criminals and treasure hunter and the problems of implementation of existing laws. Also included are the theft of more important individuals, events against the ecclesiastical heritage and against the bibliographic or documentary heritage. Another phenomenon to consider is the black market or contraband, its functioning and its relations with organized crime in relation to Spain.
