    El objetivo del ensayo fue analizar el derecho a la salud en tiempos de pandemia por COVID 19como derecho fundamental de los seres humanos, a partir de la revisión de documentos, artículos científicos provenientes de organizaciones internacionales, marco legal a nivel internacional y de Ecuador. Se encontró que la pandemia por COVID 19 ha obligado a los Estados a analizar las formas de atención, la operatividad de las estrategias implementadas y los mecanismos de evaluación que aseguren la garantía del derecho inalienable a la salud. Los mismos Estados deben adoptar todas las medidas necesarias con la finalidad de garantizar la atención adecuada y oportuna de la salud y del cuidado de las personas, particularmente de aquellas en situación de vulnerabilidad, y que todo menoscabo a los derechos humanos atribuibles a la acción u omisión de cualquier autoridad pública compromete la responsabilidad internacional de los Estados.

    The objective of the essay was to analyze the right to health in times of the COVID 19 pandemic as a fundamental right of human beings, based on the review of documents, scientific articles from international organizations, international legal framework and Ecuador. It was found that the COVID 19 pandemic has forced the States to analyze the forms of care, the operability of the strategies implemented, and the evaluation mechanisms that ensure the guarantee of the inalienable right to health. The States themselves must adopt all the necessary measures in order to guarantee adequate and timely attention to the health and care of people, particularly those in a situation of vulnerability, and that any impairment of human rights attributable to the action or The omission of any public authority commits the international responsibility of the States.
