    El arbitraje internacional se expone, por su propia naturaleza, a que de manera habitual converjan distintos ordenamientos jurídicos en una misma disputa. Esta convergencia puede ser objetiva, porque los derechos de diversos estados sean relevantes; o tener un carácter subjetivo -y menos evidente-, porque las diferentes figuras que participan en el proceso tengan formación jurídica propia de ordenamientos distintos. Este decalaje puede cobrar relevancia cuando, quien ha de resolver la disputa, tenga un bagaje legal diferente al del derecho que ha de ser aplicado. En este escenario, las herramientas de soft law material, que armonizan distintos sistemas legales, pueden ser útiles para salvar esta brecha en el campo del arbitraje internacional, ofreciendo a los árbitros y a las partes un marco común desde el que realizar la labor de interpretación de la norma aplicable al fondo.

    International arbitration is, by its very nature, exposed to the regular convergence of different legal systems within the same dispute. This convergence may be objective, because the national laws of different states are involved, or it may be subjective (and less obvious), because the different parties to the dispute have their own background from different legal systems. This mismatch may become relevant when the one who must resolve the dispute has a different legal background from the law to be applied. In this scenario, the tools of substantive soft law, which harmonise different legal systems, may be useful in bridging this gap in the field of international arbitration, offering arbitrators and parties a common framework from which to interpret the law applicable to the merits.
