Hacia una Opinión consultiva sobre cambio climático: a propósito de la solicitud de Dictamen de la comisión de pequeños Estados insulares al Tribunal Internacional del Derecho del Mar

    Esta nota aborda la solicitud de opinión consultiva presentada el 12 de diciembre de 2022 por la Comisión de Pequeños Estados Insulares sobre Cambio Climático y Derecho del Mar al Tribunal Internacional del Derecho del Mar. En dicha solicitud, esta Comisión ha pedido al Tribunal un dictamen sobre cuáles son las obligaciones específicas que tienen los Estados Parte en la Convención de las Naciones Unidas sobre Derecho del Mar para, de un lado, prevenir, reducir y controlar la contaminación del medio ambiente marino y, del otro, para proteger y preservar el medio ambiente marino. De este modo, la nota estudia la jurisdicción consultiva del Tribunal considerando los artículos 2.2 del Acuerdo constitutivo de esta Comisión y 21 del Estatuto y 138 del Reglamento del Tribunal, así como la afirmación por el Tribunal de su competencia consultiva en un previo dictamen de 2015. A la luz de las cuestiones planteadas, se consideran los aspectos sustantivos sobre los que puede pronunciarse el Tribunal en caso de reputarse competente para conocer de esta solicitud. Por último, se exponen una serie de consideraciones finales.

    This note deals with the request of an advisory opinion submitted on 12 December 2022 by the Commission of Small Island States on Climate Change and International Law to the International Tribunal for the Law of the Sea. In this request, this Commission has asked to the Tribunal what the specific obligations of the States Parties to the United Nations Convention on the Law of the Sea are, firstly, to prevent, reduce and control pollution of the marine environment, and secondly, to protect and preserve the marine environment. In this sense, this note analyses the advisory jurisdiction of the Tribunal, considering article 2.2 of the Agreement that establishes this Commission, article 21 of the Statute of the Tribunal and article 138 of Rules of the Tribunal, and also the position of the Tribunal with regards to its advisory jurisdiction on its previous advisory opinion delivered on 2015. In light of the legal questions submitted, the possible substantive answers that the Tribunal could give in case it finds itself competent are considered, too. Lastly, the note concludes with several final remarks.
