    El objetivo general de la investigación fue analizar jurídicamente el análisis del divorcio incausado como forma de disolución conyugal en el Ecuador. Dada la naturaleza cualitativa de la investigación, se procedió con el análisis jurídico del divorcio incausado, en Ecuador, se examinaron el contenido de fondo del análisis documental y bibliográfico, se concibió el uso de métodos de nivel teórico y de nivel empírico del conocimiento, como son: Analítico-sintético, inductivo-deductivo, la información se seleccionó a través de la entrevista y la técnica bibliográfica. Se aplicó una entrevista basada en una guía de preguntas a tres Jueces de Familia, Mujer Niñez y Adolescencia de la ciudad de Quevedo. Se concluye que, es crucial que el sistema legal de Ecuador respete los derechos fundamentales de las personas en un entorno que valore la autonomía individual, y se tome en cuenta esta figura incausado como un nuevo método de ruptura del vínculo matrimonial.

    The general objective of the research was to legally analyze the analysis of the unconstitutional divorce as a form of marital dissolution in Ecuador. Given the qualitative nature of the research, we proceeded with the legal analysis of the incausado divorce, in Ecuador, we examined the background content of the documentary and bibliographic analysis, we conceived the use of methods of theoretical level and empirical level of knowledge, such as: Analytical-synthetic, inductive-deductive, the information was selected through the interview and bibliographic technique. An interview based on a guide of questions was applied to three Family, Women, Childhood and Adolescence Judges of the city of Quevedo. It was concluded that it is crucial that the legal system of Ecuador respects the fundamental rights of people in an environment that values individual autonomy, and that this figure is taken into account as a new method of breaking the marriage bond.
