    El objetivo general de la investigación fue analizar jurídicamente la igualdad formal y material en la migración forzada. Esta indagación utilizó como metodología el enfoque cualitativo, se hizo uso de varias fuentes bibliográficas y documental a fin de conseguir información real y actualizada para poder alcanzar el objetivo planteado frente al problema jurídico en análisis. Se utilizaron los siguientes métodos analítico–sintético ya que con este se pudo generar un saber superior puesto que, se añadieron conocimientos adicionales a conceptos anteriores y el método inductivo. Se realizaron entrevistas a una migrante y dos abogados expertos. Se concluye que, el primer cambio que se debería implementar el uso de estrategias para dar voz a las personas migrantes que se encuentran en el país en situaciones vulnerables, implementando políticas públicas que den pie a la defensa de los derechos humanos y de libre movilidad humana y que vayan acorde al régimen jurídico.

    The general objective of the research was to legally analyze formal and material equality in forced migration. This inquiry used the qualitative approach as a methodology, making use of several bibliographic and documentary sources in order to obtain real and updated information to achieve the objective set out in relation to the legal problem under analysis. The following analytical-synthetic methods were used since with this it was possible to generate a superior knowledge since additional knowledge was added to previous concepts and the inductive method. Interviews were conducted with a migrant and two expert lawyers. It is concluded that the first change that should be implemented is the use of strategies to give a voice to migrants who are in the country in vulnerable situations, implementing public policies that give rise to the defense of human rights and free human mobility and that go according to the legal regime.
