La biometría como coadyuvante en la mitigación del delito de usurpación de identidad en la práctica notarial

    La comisión del delito de usurpación de identidad se ha convertido en una actividad reiterante en México, que se actualiza principalmente dentro de la práctica notarial, cuando un sujeto suplanta la identidad de otro con el afán de acceder indebidamente a recursos a través de la celebración de actos traslativos de dominio o al allegarse de facultades de disposición sobre bienes ajenos suplantando la identidad de otros a partir del uso de instrumentos de representación, como los poderes notariales y mandatos. La hipótesis que se plantea radica en que los medios por los cuales ordinariamente se valida la identidad de los clientes en las oficinas notariales han resultado insuficientes; por lo que, se propone el uso de la biometría como coadyuvante en la mitigación el delito de usurpación de identidad y se destaca que el principal objetivo del presente comentario es la identificación de los biométricos cuya implementación es viable en la práctica notarial. El problema de investigación se aborda desde una metodología dogmático-formalista, a partir del análisis de los fenómenos que están presentes en el objeto de estudio.

    The commission of the crime of identity theft has become a recurring activity in Mexico, which is mainly updated in notarial practice when a subject supplants the identity of another with the aim of improperly accesing resources through the celebration of transferring acts of domain or by claiming powers of disposition over third-party asset, impersonating others through the use of representation instruments, such as notarial powers and mandates. The hypothesis that arises is that the means by which the identity of clients is ordinarily validated in notarial offices has been insufficient; therefore, the use of biometrics is proposed as an adjunct in the mitigation of the crime of identity theft, and its is highlighted that the main objective of this comment is the identification of biometrics whose identification is viable in notarial practice. The research problem is approached from a dogmatic-formalist methodology, by the analysis of the phenomenon that is present in the object of study.
