    La Unión Europea quiere regular Internet y, junto al Digital Markets Act, el Digital Service Act es la principal herramienta para crear un “entorno online seguro y responsible”. El plan es ambicioso y su proyecto interesante: la transparencia y la divulgación de los algoritmos están en el centro del documento precisamente porque son cruciales para lograr una web más consciente y abierta.

    El estudio intenta acompañar el desarrollo del trabajo legislativo para tener una visión transversal de las innovaciones y sus efectos en los temas investigados.

    Se dividió en un análisis inicial, más descriptivo, de la sustancia general de la DMA y la DSA, para proseguir con una investigación de la norma inherente a la libertad de expresión y el uso de mecanismos automatizados en la armonización de las responsabilidades de las plataformas en Internet.

    Es de presumir que el interés en estos temas aumentará en los próximos años debido a la entrada en vigor de este audaz “paquete” de la UE, ya que los servicios digitales serán radicalmente redefinidos, en contra de los que deseaban un entorno en línea modelado en base a la maximización económica exclusiva, rehén de oscuros algoritmos y dark patterns. Estos temas serán primordiales en el análisis de la eficacia del Reglamento y del futuro de Internet.

    The European Union wants to regulate the internet, and, alongside the Digital Markets Act, the Digital Service Act is the main tool to create a “safe and accountable online environment”. The plan is ambitious and its blueprint intriguing: transparency and disclosure of algorithms are at the core of the paper precisely because they are crucial to achieving a more conscious and open web.

    The study attempted to follow the legislative work in order to have a diagonal slant on the innovations and their effects on the themes investigated. It was divided into an initial, more descriptive analysis of the general substance of DMA and DSA, and then proceeded with an investigation of the rule inherent in freedom of expression and the use of automated mechanisms in the harmonisation of the responsibilities of online platforms. Interest in these areas will presumably increase in the coming years due to the entry into force of this bold EU “package” because the digital services will be literally redefined, against those who desired an online environment modeled on exclusive economic maximization, hostage to obscure algorithms and dark patterns. These topics will be paramount in the analysis of the efficacy of the Regulation and the future of internet.
