The present paper is a note to Lo spazio e la norma by Nicola Capone, which investigates the relationship between law and space. The first part of the book deals with the concept of territory according to the Kelsenian theory, while the second analyses the Schmittian concept of space. Finally, in the third section, the role of space in the Italian Constitution is discussed. In this paper, I am going to follow the same pattern proposed by Capone, while trying to broaden its scope by comparing Capone’s theory to the texts of Schmitt and Kelsen.
