Quality of Judgments in the Mexico City Accusatory Criminal System

    El artículo presenta los resultados de una investigación cualitativa que tuvo por objeto describir y valorar la calidad de las sentencias dictadas en el sistema penal acusatorio en la Ciudad de México, México. Se seleccionó una muestra no estadística de sentencias dictadas por jueces del Tribunal Superior de Justicia local durante 2019, las cuales se valoraron con base en un instrumento que captura información sobre la calidad estilística y la calidad argumentativa de la sentencia. Se concluye que, independientemente de la corrección jurídica, las sentencias en el sistema acusatorio mexicano muestran un grado de calidad no óptimo, con problemas asociados a la falta de claridad y la debilidad de los razonamientos en la motivación.

    The article presents the results of a qualitative research that aimed to describe and assess the quality of the judgments in the accusatory criminal system in Mexico City, Mexico. A non-statistical sample of judgments dictated during 2019 by judges of the local Superior Court of Justice was selected and evaluated with an instrument which captures information about the stylistic and argumentative quality of the judgment. It is concluded that, regardless of the legal correctness, the judgments in the Mexican accusatory system show a non-optimal degree of quality, with problems associated to the lack of clarity and the weakness of reasoning in the justification.
