El presente trabajo analiza las consecuencias prácticas que derivan del reciente Informe del Consejo General del Poder Judicial sobre el Proyecto del Real Decreto por el que se aprueba el Reglamento de Adopción Internacional (2022) y de la Sentencia del Tribunal Constitucional, en la que el Pleno ha estimado, en parte, el conflicto positivo de competencia presentado por el Gobierno de Cataluña, declarando la nulidad de algunos preceptos de la Ley 54/2007 de Adopción Internacional y del Reglamento que la desarrolla.
The following article addresses practical consequences that derive from the recent Report of the General Council of the Judiciary on the Project of the Royal Decree approving the International Adoption Regulation (2022) and from the Constitutional Court’s Judgment, in which the Plenary has estimated, in part, the positive conflict of jurisdiction presented by the Government of Catalonia, declaring the nullity of some precepts of the Act No. 54/2007 on Intercountry Adoption and the Regulation that develop it
