Cassazione S.U. 18641/2022 e riflessioni sull’assegnazione della casa familiare

    Le Sezioni Unite della Corte di Cassazione, chiamate a dirimere il contrasto giurisprudenziale sulla questione attinente al valore economico dell’immobile in comproprietà dei coniugi legalmente separati e destinato a residenza familiare, hanno statuito che nel caso in cui lo scioglimento della comunione immobiliare venga posto in essere attraverso l’attribuzione dell’intero al coniuge collocatario, il valore dell’immobile oggetto di divisione non potrà risentire del diritto di godimento già assegnato allo stesso a titolo di casa coniugale, poiché esso verrà ad estinguersi consentendo al titolare di disporre liberamente del bene. Differente il caso in cui, invece, l’immobile venga attribuito, a seguito della divisione, in proprietà esclusiva al coniuge non assegnatario della casa familiare o venduto a terzi poiché il provvedimento di assegnazione continuerà a sussistere.

    The United Sections of the Court of Cassation, called upon to settle the jurisprudential conflict on the question relating to the economic value of the property co-owned by the spouses legally separated and intended for family residence, have ruled that in the event that the dissolution of the real estate community is placed in be through the attribution of the whole to the spouse with whom the children live, the value of the property subject to division will not be affected by the right of use already assigned to it as a marital home, since it will be extinguished allowing the owner to freely dispose of the property.
