El costo de las reparaciones, ¿quién está pagando la justicia transicional?

    En materia de responsabilidad civil extracontractual, quien comete un daño está obligado a repararlo, razón por la que, por principio, en el caso de los daños sufridos por las víctimas del conflicto armado interno, son los victimarios quienes deberían responder por los daños que ocasionaron a sus víctimas, en su calidad de obligados principales, y el Estado debería asumir los costos de la reparación pero sólo de manera subsidiaria o "residual". Pese a ello, en la práctica, el Estado, al parecer, está asumiendo con cargo al Presupuesto General de la Nación la reparación de las víctimas del conflicto armado interno, por lo tanto, en últimas, somos los contribuyentes quienes en Colombia estamos pagando los daños causados por tales victima-rios. Por este motivo considero indispensable apelar a instituciones, como por ejemplo la subrogación legal parcial, para recuperar las sumas ya pagadas y evitar así la impunidad.

    Regarding the extra-contract civil responsibility, whoever commits harm, is obliged to repair it, reason why, by principle, in the case of the damage suffered by the victims of the internal armed conflict, the perpetrators are the ones that must be responsible for the damages caused to their victims, as main perpetrators, and the state must assume the costs of the repair but only in a subsidiary or "residual" manner. Notwithstanding, in the practice, the state is assuming with charge to the General National Budget, the repair of the victims of the internal armed conflict, reason why in the end, it is us the Colombian taxpayers the ones that are paying the damages caused by such perpetrators, reason why I consider that it is indispensable to appeal to institutions like the partial legal subrogation, as mechanism to recover the amounts already paid and in this way to prevent the impunity.
