    The phenomenon of juristocracy is founded on the thesis of self-preservation hegemonic: this is the theory proposed by Ran Hirschl. The central hypothesis that guides the investigation is the applicability of the phenomenon of juristocracy in the Brazilian context. In this way, it ́s vital examines, in the national context, with emphasis on the Brazilian Supreme Federal Court (STF), components established by Hirschl as facilitators for the juristocracy. This is a theoretical analytical essay, applied in a specific case, with qualitative emphasis. The principal elements of juristocracy under the aegis of hegemonic relations are appreciated in the process of Brazilian redemocratization; reflected, from the sociological perspective of Pierre Bourdieu, about the symbiosis between the elites; examining the rise of the Judiciary and the work of the constitutional court relating them to social trust. It concludes that the empowerment of the “STF” did not occur in the political vacuum: The process towards the juristocracy is applied in the brazilian context.

    O fenômeno da juristocracia é fundado na tese de autopreservação hegemônica. As tomadas de decisões frente a temáticas políticas cortinadas de constitucionalidade podem ocultar interesses elitistas: essa é a teoria proposta por Ran Hirschl. A hipótese central que orienta o presente estudo é a aplicabilidade do fenômeno da juristocracia na conjuntura brasileira. Para tanto, são apreciados os componentes estabelecidos como facilitadores da juristocracia, reflete-se, a partir de Pierre Bourdieu, sobre elites; a ascensão do Judiciário e confiança social. Ensaio teórico analítico, aplicado em caso concreto, com ênfase qualitativa. Conclui-se que o empoderamento do STF não ocorreu no vácuo político: o processo rumo à juristocracia é aplicado no contexto brasileiro.
