Este estudio expone que la doctrina jurisprudencial que admite la concurrencia del convenio colectivo posterior en el tiempo durante la ultraactividad del anterior neutraliza la eficacia material de la ultraactividad indefinida de los convenios colectivos establecida en la reforma de 2021 y critica que no se haya adoptado regla alguna que matice o corrija este criterio del Tribunal Supremo.
This study, on the one hand, points out that the jurisprudential doctrine that admits the concurrence of the subsequent collective agreement during the period that the previous one has expired neutralizes the effect continued indefinitely of the collective agreements after their expiration established by the 2021 reform; and, on the other hand, it criticizes the fact that no rule has been adopted to nuance or correct this jurisprudential doctrine.
