La Corte Suprema chilena y la protección de la libertad personal de los migrantes: un estudio jurisprudencial

    El trabajo tiene como objetivo identificar los supuestos de afectación de la libertad personal de los migrantes derivados de la aplicación de la ley de extranjería con motivo de las medidas de expulsión y su consecuente control por la Corte Suprema vía habeas corpus; evaluar la consistencia de los argumentos planteados; y verificar la normativa aplicada en la decisión de los casos. La metodología utilizada se basa en un análisis jurisprudencial, que permite inferir como resultado que, en los últimos cinco años, el máximo tribunal ha razonado progresivamente aplicando las normas constitucionales y ciertos estándares internacionales. De esta manera, la Corte Suprema ha asegurado la protección de la libertad personal de los migrantes ante expulsiones ilegales o arbitrarias. Concluye que, a pesar de la asincronía y eventuales inconsistencias entre el marco legal y las normas convencionales y constitucionales vigentes en materia migratoria, la Corte Suprema de Chile ha acogido los habeas corpus deducidos en favor de los migrantes sujetos a medidas de expulsión

    The objectives of the paper are to identify the cases of affectation of the personal freedom of migrants derived from the application of the immigration law due to the expulsion measures and its consequent control by the Supreme Court via habeas corpus, to evaluate the consistency of the arguments raised and, finally, to verify the regulations applied in the decisions of the cases. The methodology used is based on a jurisprudential analysis that allows inferring as a result that, in the last five years the Highest Court has reasoned progressively by applying constitutional norms and certain international standards. In this way, the Supreme Court has ensured the protection of the personal freedom of migrants against illegal or arbitrary deportations. It is concluded that, despite the asynchrony and potential inconsistency between the legal framework and the conventional and constitutional norms in force in migratory matters, the Supreme Court of Chile has accepted the habeas corpus deduced in favor of migrants subject to expulsion measures.
