La Ley 17/2021, de 15 de diciembre, ¿hasta qué punto es trasunto de la frustrada proposición de ley de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales, presentada en el Congreso de los Diputados por el Grupo Parlamentario Popular durante la Legislatura XII (2016-2019)?

    La virtud de la buena política consiste en aprehender los consensos sociales y saberlos plasmar en normas útiles con vocación de avance y mejora. La Ley 17/2021 es una buena demostración de ello, y el proceso que llevó a su aprobación refuerza el papel del Parlamento como institución que sabe dar continuidad al trabajo realizado en su seno, más allá de las sustituciones en las personas que lo desarrollaron. El propósito del presente artículo es mostrar cómo en 2017 ya existía en España el consenso suficiente para impulsar mediante una Proposición de Ley la reforma de nuestro anacrónico Código Civil para ponerlo al día con las nuevas convicciones ciudadanas sobre la necesidad de respetar a los animales como seres dotados de sensibilidad; y como tal consenso era lo suficientemente fuerte para, tras el obligado paréntesis creado por la disolución anticipada de las Cortes Generales en 2019, recuperar aquella Proposición con las enmiendas aportadas entonces por los diversos grupos parlamentarios para culminar en 2021, ya en forma de ley felizmente aprobada, todo aquel trabajo.

    The virtue of good politics consists in apprehending social consensus and knowing how to translate it into useful laws with a vocation for advancement and improvement. Law 17/2021 is a good demonstration of this, and the process that led to its approval reinforces the role of Parliament as an institution that knows how to give continuity to the work carried out within it, beyond the substitutions of the people who developed it. The purpose of this article is to show how in 2017 there was already sufficient consensus in Spain to promote the reform of our anachronistic Civil Code by means of a Law Proposal to bring it up to date with the new citizen convictions about the need to respect animals as beings endowed with sensitivity; and as such consensus was strong enough to, after the forced parenthesis created by the early dissolution of the Cortes Generales in 2019, recover that Proposal with the amendments then made by the various parliamentary groups to culminate all that work in 2021, already in the form of an enacted law.
