    No cabe duda de que la buena fe desempeña un papel fundamental en el derecho de contratos moderno; sin embargo, su campo de acción y por ende el papel del juez parecen variar según la apertura del sistema de fuentes del ordenamiento en que se pretende aplicar. Así, el ejemplo de las soluciones que se ofrecen frente al fenómeno de la excesiva onerosidad sobrevenida, y en particular en tiempos de pandemia, muestra cómo ellas varían de un ordenamiento a otro según la posibilidad del juez de recurrir a la equidad para fundar su decisión.

    There is no doubt that good faith plays a fundamental role in modern contract law, however, its field of action and therefore the role of the judge seem to vary according to the openness of the system of sources of the legal system in which it is intended to be applied. Thus, the example of the solutions offered to the phenomenon of supervening hardship, particularly in times of pandemic, shows how they vary from one legal system to another according to the judge’s possibility of resorting to equity to underlie his decision.
