Crítica al control de convencionalidad secundario realizado por la Corte IDH en el caso Artavia Murillo vs. Costa Rica en la interpretación del artículo 4.1 de la Convención Americana sobre Derechos Humanos

    En esta investigación se analiza la sentencia dictada por la Corte Interamericana de Derechos Humanos en el caso Artavia Murillo vs. Costa Rica, a fin de determinar si el órgano jurisdiccional internacional se sometió, como era su deber, a la Convención Americana sobre Derechos Humanos y demás instrumentos internacionales de derechos humanos, pertinentes al caso, y si realizó ese control de convencionalidad que exige a los estados, pero al que también está obligada.

    La investigación evidencia cómo, a pesar de lo mucho que se espera de un tribunal internacional sobre derechos humanos, éste puede también incurrir en violaciones a la Convención Americana, pero sin ninguna posibilidad para quien resulte afectado, a obtener la revisión del fallo, pues las resoluciones de la Corte IDH son inapelables.

      SUMMARY:

    This investigation, analyzes the judgment handed down by the Inter-American Court of Human Rights in the Artavia Murillo vs. Costa Rica, in order to determine whether the international court submitted itself, as was its duty, to the American Convention on Human Rights and other international human rights instruments, pertinent to the case, and whether it carried out that control of conventionality that requires the States, but to which it is also bound.

     The investigation shows how, despite how much is expected from an international tribunal on human rights, it may also violate the American Convention, but without any possibility for those affected, to obtain review of the ruling, since the resolutions of the Inter-American Court are final.
