Direito e pós-modernidade: uma interpretação do filme Submarino Amarelo

    This article uses the historical-evolutionary and discourse analysis methods to investigate the artistic discourse present in the film Submarino Amarelo, released by the Beatles in 1969, to criticize the fictitious totalitarian regime implanted by the Blue Meanies in the city Pappeland. The article uses the film to parallel the bombings suffered by England during the Second World War. Then, the article promotes a criticism of legal formalism and the principle of axiological neutrality of law, which can often justify the omission of judges in the face of illegality and misuse of power practiced by authorities of other powers. Then, the article analyzes the post-positivist legal culture that emerged in the post-war period, which, moving away from legal formalism, ends up promoting a rapprochement of Law with other domains of knowledge, demonstrating that the legal system is not just based in put laws, but also in values like the dignity of the human person and the protection of vulnerable people.

    Este artigo utiliza os métodos histórico-evolutivo e da análise do discurso para investigar o discurso artístico presente na película Submarino Amarelo, lançado pelos Beatles em 1969, para fazer uma crítica ao fictício regime totalitarista implantado pelos Malvados Azuis na cidade Pappeland. O artigo utiliza o filme para fazer um paralelo com os bombardeios sofridos pela Inglaterra durante a Segunda Guerra Mundial. Em seguida, o artigo promove uma crítica ao formalismo jurídico e ao princípio da neutralidade axiológica do Direito, que muitas vezes, pode justificar a omissão dos juízes frente a ilegalidades e desvios de poder praticados por autoridades dos demais poderes. Em seguida, o artigo analisa a cultura jurídica pós-positivista surgida no pós-guerra, que ao se afastar do formalismo jurídico, acaba por promover uma reaproximação do Direito com outros domínios do conhecimento, demonstrando que o ordenamento jurídico não está assentado tão-somente em leis postas, mas também em valores como a dignidade da pessoa humana e a proteção dos vulneráveis.
