El objetivo de este estudio es poner en evidencia el desamparo de los padres en relación a la recuperación de la custodia de sus hijos.
En este estudio se analizan 40 casos de toda España en los que, habiendo presentado informes psicológicos, psiquiátricos o de trabajadores sociales donde se afirma de forma sucinta que los padres son aptos para cuidar a sus hijos y que no había razones para retirarles la guarda y custodia, finalmente perdieron la custodia de sus hijos. Se realizaron 40 entrevistas en profundidad con las familias a las que se les retiró la guarda y custodia de sus hijos.
Concluimos que los padres a los que se retira la custodia no tienen herramientas y las pocas que tienen, como puedan ser los informes psiquiátricos y psicológicos no suelen ser tenidos en cuenta provocando una clara indefensión ante el sistema.
The objective of this study is to highlight the helplessness of parents in relation to the recovery of custody of their children.
This study analyzes 40 cases from all over Spain in which, having presented psychological, psychiatric or social worker reports where it is succinctly stated that parents are fit to take care of their children and that there were no reasons to withdraw custody of them, they finally lost custody of their children. 40 in-depth interviews were conducted with families who had their children taken away from custody.
We conclude that the parents who are removed from custody do not have tools and the few they have, such as psychiatric and psychological reports, are not usually taken into account, causing a clear defenselessness before the system.
