Reconocimiento de incapacidad permanente tras jubilación anticipada por razón de discapacidad: STC 172/2021 de 7 octubre

    Se aborda el comentario de la doctrina emanada del Tribunal Constitucional en la STC 172/2021 de 7 de octubre que revoca la mantenida por el Tribunal Supremo que impedía el acceso a la incapacidad permanente a las personas con discapacidad jubiladas anticipadamente ex art. 206.2 de la Ley General de la Seguridad Social. Se demanda en amparo el reconocimiento de la gran invalidez por vulneración del artículo 14 CE derivada —sostiene la recurrente— de una interpretación discriminatoria de la norma en sede de suplicación y casación. Tanto el fondo del asunto como el iter procesal invitan al análisis desde la perspectiva de la justicia relacional, para lo que analizamos los vacíos de justicia que se producen en las dimensiones de la reciprocidad (hechos), institucionalidad (legalidad) y “socialidad” (contexto).

    The comment on the doctrine emanating from the Constitutional Court is addressed in STC 172/2021 of October 7, 2021 that revokes the one maintained by the Supreme Court that made it impossible to access Permanent Disability to people with disabilities who retired early ex art. 206.2 of the General Law of Social Security. The recognition of the great invalidity due to violation of article 14 CE derived —maintains the appellant— of a discriminatory interpretation of the norm in the seat of appeal and cassation is demanded in protection. Both the merits of the matter and the procedural interim invite analysis from the perspective of relational justice, for which we analyze the gaps in justice that occur in the dimensions of reciprocity (facts), institutionality (legality) and sociality (context).
