Juízes pragmáticos são necessariamente juízes ativistas?

    O presente artigo discute a relação entre os conceitos muitas vezes distorcidos de pragmatismo jurídico, instrumentalismo e ativismo judicial, com o objetivo de apresentar e esclarecer algumas caricaturas geralmente a eles associadas. Após a apresentação de sentidos das expressões que podem gerar aproximações e distanciamentos entre elas, recorre-se à possibilidade de justificação pragmática de posturas de autocontenção judicial para sustentar a inexistência de associação necessária entre pragmatismo e ativismo judicial – ainda que possíveis relações entre ambos não possam ser ignoradas quando juízes se declaram pragmáticos.

    This paper discusses the relationship between the often distorted concepts of legal pragmatism, instrumentalism and judicial activism, in order to present and clarify some caricatures ordinarily made of them. After presenting different meanings of the expressions that can generate approximations or distances between them, this paper explores the possible pragmatic justification for judicial self-restraint postures to justify the absence of necessary connections between pragmatism and judicial activism – even though possible associations between the two cannot be ignored when judges declare themselves pragmatic.
