O usuário do serviço público e a aplicação da Lei 13.460/2017 sob o enfoque dos Poderes Executivo e Judiciário

    With the entry into force of the Code (Law 13.460 / 17) in June 2018, for the Union, States, Federal District and Municipalities with a population greater than 500 thousand inhabitants, the article was intended to verify, in addition to the changes introduced, whether - and how - this has been used in court decisions. The judgments were searched on the website of the Paraná Court of Justice, with a time lapse from the date of entry into force (June 17, 2018) until June 17, 2020. In addition, a search was carried out on the portals of the transparency of the State of Paraná and the Municipalities of Curitiba and Londrina, with the intention of verifying if aspects of the legislation had been implemented. The research methodology adopted was the hypothetical-deductive method, based on the hypothesis that the legislation was being used in the Executive and Judiciary branches. The preliminary results were that, although it has been in force for more than two years, the law is still being little used in judicial decisions and in the transparency portals.

    Com a entrada em vigor do Código (Lei 13.460/17) em junho de 2018, para União, Estados, Distrito Federal e municípios com população superior a 500 mil habitantes, o artigo teve por intento verificar, para além das modificações introduzidas, se - e como – este vem sendo utilizado pela jurisprudência. Os julgados foram pesquisados no sítio eletrônico do Tribunal de Justiça do Paraná, com lapso temporal a partir da data de entrada em vigor (17 de junho de 2018) até 17 de junho de 2020. Além disso, realizou-se uma pesquisa nos portais da transparência do Estado do Paraná e municípios de Curitiba e Londrina, com o intento de verificar se aspectos da legislação haviam sido implementados. A metodologia de pesquisa adotada foi o método hipotético-dedutivo, partindo-se da hipótese de que a legislação estava sendo utilizada nos poderes Executivo e Judiciário. Os resultados preliminares foram no sentido de que, embora há mais de dois anos em vigor, a lei está sendo pouco empregada.
