Entender las dificultades presentes en la aplicación institucional de los derechos de los niños implica surtir un proceso de mirar atrás y auscultar el recorrido teórico que se ha llevado a cabo para llegar a promulgar estos derechos especiales. Este artículo da cuenta de una investigación de tipo cualitativa, dogmática, hermenéutica, encaminada a examinar la Convención de Derechos del Niño y la evolución ideológica que le subyace desde una mirada crítica.
Se observa el tránsito normativo del reconocimiento del infante como objeto de protección a sujeto de derechos. Un paso inacabado, por cuanto el derecho arrastra las concepciones minoristas de los niños y mecanismos de protección instaurados en un marco tutelar, anclados con fuerza en el campo jurídico por la condición de vulnerabilidad de la infancia que llega a desdibujar al niño en tanto actor capaz de contribuir a la construcción de sociedad y Estado.
Understanding the difficulties present in the institutional implementation of children’s rights implies a process of looking back and consider to the theoretical journey that has been carried out in order to enact these special rights. This article reports on a qualitative, dogmatic, hermeneutic research aimed at examining the Convention on the Rights of the Child and its underlying ideological evolution from a critical viewpoint. The normative transit of the recognition of the child as an object of protection to the subject of rights is observed. An unfinished step, inasmuch as the law drags the retail conceptions of children and protection mechanisms established in a tutelary framework; firmly anchored in the legal field by the condition of vulnerability children, which comes to blur the child as an actor capable of contributing to the construction of society and State.
