La sobrerrepresentación de menores extranjeros en los centros de internamiento

    La sobrerrepresentación de los jóvenes extranjeros en los centros de internamiento para menores infractores es un hecho constatado por la literatura criminológica. Se pueden esgrimir diferentes argumentos para explicar dicho fenómeno. El presente artículo tiene por objeto contrastar diferentes hipótesis explicativas de esta sobrerrepresentación. Dividiendo estas hipótesis en aquellas fundamentadas en el comportamiento delictivo de los menores extranjeros y las que ponen su foco en la actividad del sistema penal. Para testar estas hipótesis, se utilizan datos oficiales de detenciones policiales y condenas en España, así como datos secundarios obtenidos de investigaciones previas. El estudio y contraste de dichos datos permite afirmar que el comportamiento delictivo de los menores extranjeros es un elemento insuficiente para explicar su sobrerrepresentación en los centros de internamiento. Este hecho sugiere que la actividad selectiva del sistema penal sobre estos menores toma un papel relevante a la hora de entender las tasas de internamiento.

    The overrepresentation of young foreigners in juvenile prisons is a fact that has been noted in the Spanish criminological literature. Various arguments can be put forward to explain this phenomenon. This article aims to contrast the different explanatory hypotheses of this overrepresentation with the data available, dividing the hypotheses into those based on the criminal behavior of foreign minors and those that focus on the activity of the Juvenile Justice Criminal System. For this purpose, official data about police arrests and convictions are used with secondary data obtained from previous research. The study and contrast of these data allows us to affirm that the criminal behavior of foreign minors is an insufficient element to explain their overrepresentation in juvenile prisons. This suggests that the biased activity of the Juvenile Justice Criminal System on these minors plays a relevant role on those detention rates.
