“Teoría de la Imprevisión” a la luz del ordenamiento jurídico nicaragüense: necesidad de regulación y aprovechamiento de experiencias extranjeras

    El presente trabajo de investigación gira en torno al fenómeno mediante el cual ciertas situaciones imprevisibles pueden alterar gravemente las condiciones originales de contratación que llevaron inicialmente a las partes a entrar a una relación contractual de largo plazo, haciendo de su cumplimiento excesivamente oneroso para uno de los contratantes. Ante tal premisa, abordaremos como la doctrina y legislación han identificado en la figura de la “Teoría de la Imprevisión” una solución que permite ajustar la relación contractual ante la nueva realidad devenida, enfatizando que esta figura es de uso a manera de prudente excepción ante la regla Pacta Sunt Servanda. Abordaremos esta figura en torno a su situación jurídica en Nicaragua y el aprovechamiento de las experiencias extranjeras de Italia y Alemania para poder hacer un diagnóstico y las recomendaciones que se tengan a bien.

    The present research work revolves around the phenomenon whereby certain unforeseeable situations can seriously alter the original contracting conditions that initially led the parties to enter into a long-term contractual relationship, making their compliance excessively burdensome for one of the parties. Given this premise, we will address how the doctrine and legislation have identified in the figure of the "Theory of the Unforeseen" a solution that allows to adjust the contractual relationship to the new reality, emphasizing that this figure is of use as a prudent exception to the Pacta Sunt Servanda rule. We will address this figure around its legal situation in Nicaragua and the use of foreign experiences from Italy and Germany to be able to make a diagnosis and the relevant recommendations.
