Una de las principales reglas del arbitraje es que el órgano arbitral debe ser independiente, imparcial, neutral y diligente en sus actuaciones durante todo el procedimiento arbitral. Ahora bien, la sofisticación y complejidad del arbitraje como procedimiento de resolución extrajudicial de controversias puede minar la confianza en la eficiencia del sistema. En este sentido, reviste una trascendental importancia la ética profesional (arbitral) y la honorabilidad del árbitro. Este artículo busca poner en valor la importancia de la neutralidad del árbitro, de la integridad del arbitraje y del prestigio de este procedimiento.
One of the main principles of arbitration is that the arbitral tribunal must be independent, impartial, neutral and diligent in carrying out its duties throughout the arbitration proceedings. However, the sophistication and complexity of arbitration as an extra-judicial dispute resolution procedure can undermine confidence in the efficiency of the system. In this regard, the professional (arbitral) ethics and the honourability of the arbitrator are of major importance.
