Las vicisitudes de la Convención sobre el delito de genocidio en este nuevo siglo

    Los cruentos actos cometidos durante la Segunda Guerra Mundial constituyeron un innegable acicate para un número considerable de Estados que decidieron acoger de manera positiva la iniciativa relativa a la adopción de un instrumento jurídico internacional que tuviera por objeto la tipificación de ilícitos similares a los cometidos durante la referida contienda bélica. Finalmente, en 1948, se adoptó la Convención para la Prevención y Sanción del delito de genocidio y, en 1951, se produjo su entrada en vigor. Han pasado, pues, más de setenta años desde que tuvo lugar la codificación internacional de este grave crimen. Así las cosas, analizaremos e interpretaremos la citada Convención a la luz de sucesos actuales. Todo ello se hará con el propósito de averiguar si el contenido del acuerdo adoptado en el Palacio de Chaillot, el 9 de diciembre de 1948, es el oportuno.

    The heinous acts committed during the Second World War constituted an undeniable incentive for a considerable number of States that decided to positively welcome the proposal concerning the adoption of an international legal instrument that aimed the criminalization of illicit that were similar to the ones committed during the referred armed conflict. Finally, in 1948, the Convention for the Prevention and Punishment of the crime of genocide was adopted and, in 1951, it entered into force. Hence, more than seventy years have passed since this severe crime was internationally codified. Thus, we will analyze and interpret the content of the latter in the light of current situations. All this will be made with the purpose of determining if the content of the agreement adopted at the Chaillot Palace, on December 9 of 1948, is a suitable one.
