La crisis sanitaria provocada por el COVID-19 ha hecho que, en un período de sólo quince días, diez Estados parte del CEDH hayan notificado, durante la primera ola de la pandemia, a la Secretaria General del Consejo de Europea su decisión de derogar temporalmente el cumplimiento de determinadas obligaciones del Convenio para poder adoptar medidas restrictivas de derechos con el objetivo de contener la transmisión del virus entre la población. Sin embargo, el resto de Estados, que igualmente se han visto afectados por la pandemia, no han considerado necesario recurrir a la cláusula derogatoria al entender que las medidas restrictivas adoptadas eran compatibles con el Convenio. El objetivo de este estudio es analizar la aplicación que se ha hecho de la cláusula derogatoria prevista en el artículo 15 del Convenio a raíz de la emergencia sanitaria y valorar su oportunidad desde la perspectiva del sistema de protección de los derechos humanos establecido por el Convenio, teniendo en cuenta si quizás hubiese sido preferible no acudir a ella.
The sanitary crisis caused by COVID-19 has meant that, in a period of only fifteen days, ten States parties to the ECHR have notified, during the first wave of the pandemic, the Secretary General of the Council of Europe of their decision to temporarily derogate from certain obligations of the Convention in order to be able to adopt restrictive measures of rights to contain the transmission of the virus among the population. However, the rest of the States, which have also been affected by the pandemic, have not considered it necessary to resort to the derogation clause considering that the restrictive measures adopted were compatible with the Convention. The objective of this study is to analyze the application of the derogatory clause of Article 15 of the Convention as a result of the sanitary emergency and assess its opportunity from the perspective of the human rights protection system established by the Convention, considering if perhaps it would have been preferable not to apply it.
