o presente trabalho tem por objetivo o estudo do diálogo entre as jurisdições nacional e internacional no contexto de violação sistêmica dos direitos humanos pelo Estado brasileiro. Através da formação tríade do processo, jurisdição e das ações constitucionais que envolvem o processo constitucional, os autores defenderão que a supervisão de cumprimento das decisões internacionais em âmbito internacional não é capaz de efetivar o cumprimento das decisões da Corte Interamericana (CtIDH) no Brasil, surtindo a necessidade do procedimento que irá nortear o controle de legalidade efetivo no decorrer dos atos processuais praticados pela jurisdição estatal. Outrossim, até hoje no Brasil não há previsão constitucional de execução de sentenças da Corte IDH, porquanto o Direito Processual Constitucional atua como disciplina-instrumento na sistematização de um Código de Processo Constitucional para regulamentar a execução de sentenças internacionais e efetivar a ordem constitucional no direito interno.
The aim of this paper is to study the dialogue between national and international jurisdictions in the context of systemic human rights violations by the Brazilian State. Through the analysis of the threesome formed of process, jurisdiction and constitutional actions that involve the constitutional procedure, the authors will defend that the supervision of compliance with international decisions at the international level shows that Brazil is not able of enforcing the decisions of the Inter-American Court (IACHR). Therefore it arises the need for a procedure that enables the effective legality control during the procedural acts practiced by the state jurisdiction. By the other hand, even today in Brazil, there is no constitutional provision for the execution of judgments of the Inter-American Court, since Constitutional Procedural Law acts as an instrumental discipline in the systematization of a Constitutional Procedure Code to regulate the execution of international sentences and enforce the constitutional order in law internal.
