El objetivo del artículo es evidenciar la manera en que la modernidad y su crisis se han dado en el contexto latinoamericano y la forma en que se intenta dar solución a sus conflictos con una alternativa de cura integral;
mediante el establecimiento del Estado social de derecho, lo cual recrea la figura sociológica del caos creativo.
La metodología implementada es deductiva y a partir de esta se describen las dinámicas de la modernidad, la modernización y el modernismo y su crisis en Europa y occidente y, posteriormente, en América Latina, para, finalmente, presentar la propuesta de solución a los embates de la época con la asunción del Estado social de derecho que es, a su vez, la propuesta para curar las contrariedades del modernismo político expresado en la figura del Estado de derecho.

The objective of the article is to demonstrate the way in which modernity and its crisis have taken place in the Latin American context and how a solution to its conflicts tries to be given with an alternative of comprehensive cure through the establishment of a social state based on the rule of law which recreates the sociological image of creative chaos.
The methodology implemented was deductive and the dynamics of modernity, modernization and modernism and its crisis in Europe and the West countries and then in Latin America is described from it to finally present a proposition of a solution to the onslaughts of the time of the social state based on the rule of law which is, at the same time, the proposition to cure the controversies of political modernism expressed in the image of the rule of law
