Hoy en día, la SAS es el tipo societario de mayor importancia en Colombia. La protección reforzada de la responsabilidad patrimonial de sus socios es, sin lugar a dudas, una de las características de mayor peso en el proceso de elección de los comerciantes. No obstante, al realizar una ‘lectura’ con fundamento en los principios y valores constitucionales, estas buenas intenciones se ven ‘amenazadas’ o al menos ‘limitadas’.
Este artículo, el primero de dos textos, realiza un acercamiento a la teoría general de la figura del levantamiento del velo corporativo a través de la constitucionalización del derecho.

The reinforced protection of the patrimonial liability of its partners is, undoubtedly, one of the major characteristics in the election process by the businessperson. However, these good intentions are threatened or at least limited by making a ‘reading’ based on constitutional principles and values. This article, the first of two texts, makes an approach to the general theory of the figure of the lifting of the corporate veil through the constitutionalization of law.
