    El objeto del presente trabajo es analizar si resulta jurídicamente posible que los cónyuges, ante una situación de crisis matrimonial, y dada la discutida naturaleza del derecho de uso sobre la atribución de la vivienda familiar y su carácter asistencial gratuito, a la vista de las tensiones que se generan para el cónyuge propietario que se ve privado del uso de su propia vivienda, puedan pactar en el convenio matrimonial otras fórmulas jurídicas, como el atribuir un verdadero derecho real de uso y habitación, que permita además su configuración en el título constitutivo bien con carácter gratuito bien con carácter oneroso en función de sus necesidades personales y familiares

    The purpose of this study is to analyze whether it is legally possible for spouses, in a situation of marital crisis, and given the disputed nature of the right of use on the allocation of family housing and its free care on the face of the tensions that are generated for the owner spouse who is deprived of the use of his own home, may agree in the marriage agreement other legal formulas, such as attributing a real right of use and habitation, which also allows its configuration in the constitutive title well free of charge or onerous depending on your personal and family needs.
