  La noción de residencia habitual del menor ocupa un lugar central en el sistema de competencia judicial internacional en materia de responsabilidad parental diseñado por el Reglamento Bruselas II bis. La ausencia en el Reglamento de una definición del concepto nos lleva a definir la residencia habitual del menor como un concepto autónomo del Derecho de la Unión que el TJUE ha ido clarificando. En términos generales, el TJUE ha considerado la residencia habitual del menor como una cuestión de hecho que debe ser concretada en el caso concreto. Ahora bien, a su vez, ha ido estableciendo unos criterios interpretativos que son precisamente el objeto de análisis del presente artículo

  The notion of habitual residence of the child plays a central role in the in Brussels II A Regulation system of jurisdiction in matters of parental responsibility. The lack of a definition in the Regulation leads us to define the habitual residence of the child as an autonomous concept of UE Law that the CJEU has clarified. In general terms, the CJEU has considered the child’s habitual residence as a matter of fact that must be specified in the specific case. However, at the same time, it has established interpretative criteria that are precisely the object of analysis of this article
