El Tratado de 1967: la extensión y garantía del mantenimiento de la paz y la seguridad internacional en el espacio

    Este ensayo busca hacer un análisis del Tratado sobre los principios que deben regir las actividades de los Estados en la exploración y utilización del espacio ultraterrestre, incluso la Luna y otros cuerpos celestes, de 1967, también llamado la Constitución del Espacio, planteando y defendiendo la tesis de que dicho Tratado es parte integral de la Carta de las Naciones Unidas, como extensión del principio de mantenimiento de la paz y seguridad internacional consagrado en el artículo primero de dicha Carta. Se hace un recuento histórico de los hechos que llevaron a la suscripción del Tratado, y se revisa su articulado para ilustrar la tesis y ver cómo este procura crear un régimen jurídico a largo plazo para la consecución de sus fines, lo cual responde a la crisis de vinculatoriedad actual del derecho espacial y brinda una lectura nueva del documento.

    This essay aims to analyze the Treaty on Principles Governing the activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies of 1967, also called the Outer Space Constitution, defending the thesis that states that the mentioned treaty is an integral part of the United Nations Charter as an extension of the principle of the maintenance of international peace and security stated in the first article of the Charter. At first, this essay makes a historical background of the events that lead to the creation of the treaty, and later there is a revision of the articles to illustrate the thesis and demonstrate how the treaty looks to create a longstanding juridical regime for the fulfillment of its goals. This analysis answers to the actual binding crisis of space law providing a new approach to the document.
