El concepto de activismo judicial es una creación norteamericana con bastante influencia en Iberoamérica. A través de los años se han dado muchas definiciones de lo que es el activismo judicial, confundiéndose con el término de gobierno de los jueces. Debido a sus diferentes significaciones ha sido muy criticado por la doctrina, aunque algunas interpretaciones de la Corte Suprema norteamericana han permitido desde lo judicial identificar mejor los casos en los cuales los jueces son llamados a ser activistas. Sin embargo, estas interpretaciones sobre lo que es el activismo judicial deben ser adaptadas para ser correctamente utilizadas en el contexto iberoaméricano, por las particularidades propias de desigualdad social, de problemas en la distribución de la riqueza y del mal funcionamiento de los mecanismos democráticos, tan variables en nuestra cultura.
The concept of judicial activism is an American creation with a lot of influence in Ibero-America. Through the years, many definitions have been given to judicial activism, which merges with the expression «government by judges». The concept has been criticized lately by the doctrine due to its different meanings, despite some interpretations of the Supreme Court of the United States allowing, from the judicial perspective, to better identify the cases in which the judges are called to be activists. However, these interpretations of judicial activism must be adapted to be correctly used in the Ibero-American context, because of the particularities of social inequality, problems in the distribution of wealth and the malfunctioning of democratic mechanisms, which varies widely in our culture.
