La potestad normativa de la CNMC

    El reciente Real Decreto Ley 1/2019 ha modificado la Ley 3/2013, de creación de la Comisión Nacional de los Mercados y la Competencia, aumentando el ámbito de la potestad normativa de dicho organismo. Con este motivo, la CNMC ha elaborado diversas circulares en el ámbito de la energía, que han dado lugar a una doctrina del Consejo de Estado. Si bien la atribución de la potestad normativa plantea problemas relevantes, como es el relativo al carácter de la potestad normativa, los trámites preceptivos en el procedimiento de elaboración y las relaciones con otras normas procedentes del Gobierno y sus miembros constituyen también una oportunidad para avanzar en la mejora de la calidad normativa, dada la configuración de la CNMC como organismo independiente y dotado de alta capacidad técnica.

    The recent Royal Decree-Law 1/2019 has modified Law 3/2013, of creation of the National Commission of Markets and Competition (CNMC), has increased its scope of regulatory power. For this reason, the CNMC has developed several circulars in the field of energy, which have resulted in a doctrine of the State Council.

    Although the attribution of the normative power raises relevant problems, such as the one related to the character of the normative power, the mandatory procedures in the elaboration of the norms and the relations with other norms from the Government and its members, it is also an opportunity to advance in the improvement of the normative quality, given the configuration of the CNMC as an independent body and endowed with high technical capacity
