Los contratos “públicos” artísticos en las artes escénicas

    El 9 de marzo de 2018 entró en vigor la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público (LCSP). Se trata de una norma básica y, por tanto, aplicable a todo el Estado, sin perjuicio del desarrollo que puedan hacer las Comunidades Autónomas (CCAA).

    En este trabajo se pretende analizar su impacto en aquellos sectores donde no se gestionan habitualmente procedimientos administrativos, concretamente cómo se puede aplicar esta nueva legislación en el sector artístico, especialmente en las artes escénicas, sin llegar a morir en el intento.

    ¿Qué hay que hacer para contratar a un/a escenógrafo/ a o a un/a figurinista, con la nueva ley en la mano? ¿El teatro tiene la consideración de administración pública? ¿Es un poder adjudicador no administración pública? ¿Cómo contrato un músico o un/a coreógrafo/a para mi espectáculo? ¿Y si quiero contratar a una compañía teatral en el teatro del municipio? ¿Y si la compañía es extranjera? La casuística es muy amplia, y las preguntas casi infinitas. No pretendo dar respuesta a todas, tan sólo intentar incardinar estas necesidades en la nueva Ley y dar algunas respuestas y/o propuestas, desde mi experiencia e interpretación para que puedan aportar alguna luz a los actores en estos procedimientos.

    On March 9, 2018, Law 9/2017, of November 8, on Public Sector Contracts (LCSP) entered into force. It is a basic norm and, therefore, applicable to the whole State, without prejudice to the development that the Autonomous Communities (CCAA) can do.

    This paper aims to analyze its impact in those sectors where administrative procedures are not usually managed, specifically how this new legislation can be applied in the artistic sector, especially in the performing arts.

    What needs to be done to hire a set designer or figurine, with the new law in hand? Is the theater considered public administration? Is a contracting authority not public administration? How do I hire a musician or choreographer for my show? What if I want to hire a theater company in the theater of the municipality? And if the company is foreign? The casuistry is very broad, and the questions almost endless. I do not intend to respond to all, just try to incardinate these needs in the new Law and give some answers and/or proposals, from my experience and interpretation so that they can bring some light to the actors in these procedures
