    Democratic participation is one of the bases of the Rule of Law and thus should be found throughout all the branches of the State, including the judicial one. One of the ways to measure this kind of participation could be through analy-zing the possibilities of citizens to access their constitutional courts. This access can be direct or indirect, individual or colective, and could differ within the different countries. The following paper aims to analyze the indirect participation of citizens in the Constitutional courts of Germany, Brazil and France. At the end, it will be notice that the element of democratic participation is usually conflicting with the effi-ciency of the work in the courts. Furthermore, it is remarkab-le that some of the internal designs of the courts, made for ensuring this kind of participation, are often neglected by the courts’ internal regulations.

    La participation démocratique, une des bases de l’État de Droit, doit être présente parmi tous les pouvoirs de l’État et, cela vaut dire aussi, certainement, dans le pouvoir Judiciaire. Une des manières d’apprécier une telle participation est à travers l’accès des citoyens aux Cours constitutionnelles. Cet accès peut être développé d’une manière directe ou indirecte, individuelle ou collective, de même qu’il peut varier d’un pays à l’autre. La présente recherche a comme but l’analyse de la participation citoyenne indirecte dans les Cours constitutionnelles en Allemagne, Brésil et France. À la fin, il est possible de constater que l’élément dela participation démocratique est souvent mis en conflit avec l’efficacité de ces Cours. En outre, il est remarquable certaines conceptions institutionnelles aient été créés pour garantir cette participation, mais ont en pratique un résultat différent en raison des normes internes des Cours.
