A paralisação da atividade econômica como um dos efeitos do dever fundamental de proteção do meio ambiente do trabalho pelo empregador

    Esta pesquisa analisou o dever fundamental de o empregador proteger o meio ambiente do trabalho e o efeito desse reconhecimento na medida drástica de paralisação da atividade econômica, caso se ausente do local da prestação laborativa a higidez ambiental. A pesquisa utilizou como referencial teórico a crítica de Karl Marx e Friedrich Engels sobre o dualismo abstrato, artificial, antagônico e contraditório entre Estado e sociedade civil, e a introdução de mediadores entre a pretensão emancipatória dos seres humanos. Considerouse que o direito constitucional brasileiro prescreve o dever fundamental de o empregador proteger o meio ambiente laboral, bem como, ser consequência desse dever, a promoção excepcional da paralisação da atividade econômica por ato do empregador (independentemente de ordem Estatal), caso faltem ao local de trabalho condições ambientais adequadas.

    This research analyzed the employer’s fundamental duty to protect the working environment and the effect of such recognition in the drastic measure of a stoppage in the economic activity, if there is no environmental healthiness in the workplace. The research used as a theoretical reference the review of Karl Marx and Friedrich Engels on the abstract, artificial, antagonistic and contradictory dualism between state and civil society, as well as the introduction of mediators in the human emancipatory claim. It was considered that the Brazilian constitutional law prescribes the employer’s fundamental duty to protect the working environment, as well as being a consequence of this duty the exceptional promotion of a paralysis in the economic activity by an act of the employer (independently of state order), in case there is a lack of satisfactory environmental condition on the working place.
